Two Tracks, Two Speeds

U.S. crypto regulation is advancing on two parallel but independent paths. The CFTC is exercising its existing statutory authority to move crypto market rules forward, while the CLARITY Act, which would define jurisdictional lines between the CFTC and the Securities and Exchange Commission, has not cleared the legislative hurdles needed to become law. Agency rulemaking and congressional legislation are distinct processes with different timelines and legal weight. A rule issued by the CFTC carries the force of federal regulation but operates within the agency’s current, contested authority over digital assets. A statute passed by Congress would settle jurisdictional questions directly, something no agency action alone can accomplish.

The CFTC has recently sent draft crypto market rules to the White House for review, a step that signals rulemaking has reached an advanced stage. That pipeline of activity continues even as the legislative side remains gridlocked.

Why CFTC Rulemaking Matters for Market Participants

For Bitcoin miners, trading venues, and market participants, the pace of CFTC action shapes the near-term compliance landscape. Clearer market rules affect how trading activity is supervised, what disclosures firms must make, and which platforms fall under federal oversight. These implications are practical, not abstract.

The CFTC has also recently extended its crypto software broker exemption as the CLARITY Act stalls, a move that illustrates how the agency is managing the gap left by absent legislation. Separately, the SEC and CFTC have each taken steps to ease crypto rules through their own channels, reinforcing the pattern of agency-led progress in the absence of a unified congressional mandate.

What agency rules cannot do is resolve the underlying jurisdictional dispute between the CFTC and the SEC over which tokens qualify as commodities versus securities. That question, central to the CLARITY Act’s purpose, remains open until Congress acts or courts draw a definitive line.

A Stalled Bill Leaves the Regulatory Picture Incomplete

The CLARITY Act’s failure to advance means the legislative track has not delivered the statutory clarity its title promises. A stalled bill does not kill the proposal; it can be reintroduced, amended, or revived in a future session. But until it moves, the CFTC and SEC continue operating under legal frameworks not designed with digital assets in mind.

For Bitcoin specifically, this environment creates a dual watchpoint: any progress the CFTC publishes in its rulemaking process, and any change in the CLARITY Act’s momentum on Capitol Hill. A shift in either direction would alter the regulatory landscape for Bitcoin trading venues and the firms that service them. The current split between agency action and legislative inaction is not a stable equilibrium. Rulemaking without a statutory foundation remains vulnerable to legal challenge, and Congress retains the power to override or constrain agency rules through legislation at any point.
